Terms of Service

These Terms of Service (hereinafter referred to as "the Terms") set forth the conditions for use of the application "Poker Bankroll Manager" (hereinafter referred to as "the App") provided by Kawai Hiromu (hereinafter referred to as "the Operator"). By using the App, users are deemed to have agreed to the Terms.


Article 1 (Applicability)

The Terms apply to all matters related to the use of the App.


Article 2 (Purpose of Use)

The App is a tool designed for bankroll management and record-keeping in poker and other games.

The App does not provide investment advice, gambling advice, or income guarantees.


Article 3 (Apple-Related Acknowledgement)

  1. The user and the Operator acknowledge that the Terms are entered into between the Operator and the user only, and that Apple Inc. ("Apple") is not a party to the Terms.
  2. The Operator, not Apple, is solely responsible for the App and its content.
  3. The Terms shall not conflict with the rules set forth in the Apple Media Services Terms and Conditions (available at https://www.apple.com/legal/internet-services/itunes/).

Article 4 (Scope of License)

  1. The Operator grants the user a non-transferable license to use the App on any Apple-branded products that the user owns or controls, in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions.
  2. This license permits access to the App by other users through Apple's Family Sharing or volume purchasing programs.

Article 5 (Terms of Use)

  1. Users shall use the App at their own responsibility.
  2. Minors must obtain the consent of a parent or guardian before use.
  3. The App does not promote or facilitate gambling activities.

Article 6 (Subscription)

  1. The App includes a paid plan (Pro Plan).
  2. Pricing follows the prices displayed within the App.
  3. Payments are processed through Apple's In-App Purchase system.
  4. Subscriptions are automatically renewed.
  5. Cancellations must be made through Apple ID settings.
  6. Refunds are subject to Apple's policies.

Article 7 (Advertising)

Advertisements may be displayed in the free version.

The Operator assumes no responsibility for the content of advertisements.


Article 8 (Maintenance and Support)

  1. The Operator is solely responsible for providing any maintenance and support services with respect to the App.
  2. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Article 9 (Prohibited Actions)

Users shall not engage in the following actions.


Article 10 (Intellectual Property)

  1. Copyrights and other intellectual property rights related to the App belong to the Operator.
  2. In the event of any third-party claim that the App or the user's possession and use of the App infringes that third party's intellectual property rights, the Operator, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Article 11 (Disclaimer and Warranty)

  1. The Operator assumes no liability for damages arising from use of the App.
  2. The Operator is not responsible for data loss, incorrect records, or device malfunctions.
  3. The content of the App may be changed without prior notice.
  4. In the event the App fails to conform to any applicable warranty, the user may notify Apple, and Apple will refund the purchase price for the App to the user. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

Article 12 (Product Claims)

The Operator is responsible for addressing any claims relating to the App, including but not limited to product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation. Apple is not responsible for any such claims.


Article 13 (Changes and Suspension of Service)

The Operator may change or suspend all or part of the App without prior notice.


Article 14 (Legal Compliance)

The user represents and warrants that:

  1. The user is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
  2. The user is not listed on any U.S. Government list of prohibited or restricted parties.

Article 15 (Third-Party Terms)

The user must comply with applicable third-party terms of agreement when using the App.


Article 16 (Third-Party Beneficiary)

The user and the Operator acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of the Terms. Upon the user's acceptance of the Terms, Apple shall have the right (and will be deemed to have accepted the right) to enforce the Terms against the user as a third-party beneficiary thereof.


Article 17 (Changes to the Terms)

The Operator may change the Terms when deemed necessary. The revised Terms take effect upon publication within the App.


Article 18 (Governing Law and Jurisdiction)

The Terms are governed by the laws of Japan.

Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of the courts of Japan as the court of first instance.
